Family and Medical Leave Act (F.M.L.A.)

Policy Number: C.E.S.P. 7-18
Date Revised: 10-13-2004
Supersedes: 9-8-2003

Summary: Establishes policy regarding the Family and Medical Leave Act.

The Family and Medical Leave Act states that eligible employees are entitled to a maximum of 12 weeks of job protected unpaid family and medical leave in a rolling 12-month period, which begins when F.M.L.A.  is first requested and approved. Employees are eligible if they have worked for Extension for at least one year, and for at least 1,250 hours (60 percent time) during the previous 12 months.  F.M.L.A.  runs concurrently with sick and annual leave. F.M.L.A.  may be taken for the serious illness of the employee, for the birth or adoption or foster care of a child, and for the care of a child, spouse, or parent who has a serious health condition.

• While the employee is on F.M.L.A., Extension will pay the employer's share of the health and dental insurance, if applicable.  Extension will continue to pay for the basic life and basic long-term disability insurance for the employee.

• Upon return from F.M.L.A., the employee is entitled to return to the position formerly occupied or an equivalent position with equivalent benefits, pay and other terms and conditions of employment.
