To be considered formally, a grievance must be submitted in writing
to the employee's immediate supervisor within the 10 day time-frame
indicated above. The written grievance must include a clear statement of
the issue being grieved, a report on the
efforts to settle informally, such facts as may be needed in arriving at
a prompt and reconcilable resolution, and the desired outcome of the
grievance.
The supervisor will review the informal decision previously made.
If a mutually agreeable settlement still cannot be reached, the
supervisor will add a statement to this effect to the written grievance,
note the date it was received, and forward to the next level of
supervision within two working days.
The next-level supervisor will consider and answer the grievance in
writing not later than five working days following its receipt. The
supervisor may:
(a) consult with immediate supervisor,
(b) ascertain all pertinent facts,
(c) examine policies involved,
(d) discuss the matter with the employee, and
(e) if feasible, settle the grievance within the framework of existing policy
to the satisfaction of the employee and his/her supervisor.
If the supervisor fails to respond or if a mutually agreeable
settlement is not reached, the employee may then submit the written
grievance within seven working days to the Associate Vice President for
Agriculture - Extension. The supervisor's written response to the
employee's grievance will be forwarded to the Associate Vice President
for Agriculture - Extension. The Associate Vice President for
Agriculture - Extension may issue a decision or may refer the matter to
a grievance panel for further investigation.
The panel will make an investigation and
submit a statement of findings and recommendations to the Associate Vice
President for Agriculture - Extension as part of the final
decision-making process.
Within five working days after decision by the Associate Vice
President for Agriculture - Extension, the employee has the right to
submit a written appeal to the Associate Vice President for Agriculture
- Extension requesting that the decision be reviewed by the Vice
President for Agriculture.
An employee filing a grievance will at all times be free from
reprisal.
The grievance panel will consist of three employees.
The Associate Vice President for Agriculture – Extension presents a pool
of five classified or non-classified employees, as appropriate, as
possible grievance panel members. From this group, a three member
panel will be chosen to hear the grievance. The aggrieved employee
and Associate Vice President for Agriculture – Extension each make a
selection from the five member pool. The two members selected will then choose
the third member of the panel from the pool.
